Common Ground Mediation

My approach as a mediator is to help the parties explore all their options and the consequences of their choices. My role is to be the balance wheel, listening carefully, making sure each party has their say and is heard by the other. I structure the “process” of the mediation; the parties are in control of the decisions. As the mediator, I do not represent either party as a lawyer. However, because of my legal training I can draft the legal agreement that will be binding on the parties and can be adopted by a court. I advise each party to consult with an attorney or other relevant professional, such as an accountant, at any point in the mediation, and especially prior to signing any agreement.

Collaborative Law

Law Offices of Scott C. Marks

I have been practicing family law on the North Shore for over 30 years. Throughout my career, I realized that most of my clients were better served if they resolved their differences instead of litigating their issues in Court. By agreeing they might reduce the emotional and financial costs to the entire family of divorce. So, I trained in mediation and collaborative practice and for the past 15 years or so have been offering these alternatives to litigation. As a mediator and collaborative practitioner, I help people to discuss and resolve issues such as: divorce, alimony, child custody and support, college expenses, parenting, property division, grandparent’s rights, prenuptial agreements, and modification and enforcement of existing orders. I would be happy to describe mediation and collaborative divorce with you in more detail and to see if your case may be appropriate for these options to litigation. Please feel free to call or write.

Solutions Through Mediation: Marcia E. Tannenbaum, Esq.

A family law attorney and divorce lawyer for more than two decades, Attorney Tannenbaum offers expert guidance in both divorce mediation and collaborative practice—two non-adversarial approaches that enable you to resolve legal conflicts through negotiation, without litigating. In mediation, the parties work with one professional mediator; in collaborative practice, each party has separate legal representation. With either approach, you all come together at the same table, in a safe space, where you are able to hear each other and to work out a mutually acceptable solution. The process is driven by you, the client, rather than a pushy divorce lawyer and the court system. Mediation and collaborative practice should take less time than drawn-out legal battles and are typically less costly, both emotionally and financially. You resolve issues with your dignity in tact.
